Updated: 2018-07-30

When drafting a labor contract, the employer and employee must clearly state the rights and obligations of both parties. And the contract terms must include: the term (length) of the labor contract; the nature of the work and the work location; as well as provisions regarding working hours, rest and vacations; wages; social insurance; labor protection, working conditions and protection against occupational hazards. Other terms must be incorporated in the labor contract, or shall be deemed to be incorporated in it, to accord with Chinese laws or regulations.
